Futuro Remoto 2019.The Legal Design & Visual Law demonstration laboratory. Let’s draw the privacy of the future.

In line with the theme chosen this year for the event, “Being 4.0” to bring the audience of young and less young people ever closer to new technologies, the workshop, entitled “Examples of Legal Design and Visual Law applied to Privacy Documents”, falls within the “Demonstration” type, in the thematic Area “Smart Factory, Design and Creativity”. The Legal design discipline aims in fact to bring the legal world closer to people, placing them right at the centre of planning and providing services even in the legal world in order to make the user experience (UX) more intuitive, usable and inclusive. The design methodologies and Visual Law techniques offer the right opportunity to review the way the legal activity’s main tools, i.e. documents, contracts and proceedings, are thought and told.

Why Data Map or Categorize Vendors When the CCPA Does Not Require Either?

Under the European Union’s General Data Protection Regulation (GDPR), a data map fulfills Article 30’s obligation that controllers “maintain a record of processing activities under its responsibility.” For those who are familiar with the General Data Protection Regulation (GDPR), minor parallels can be drawn between “controller” under GDPR and a “business” under the CCPA, along with similarities between “processor” under the GDPR and “service provider” under the CCPA. The similarities should be taken lightly, yet do assist in designing an efficient and effective overarching privacy and governance program. In sum, map data flows across the organization. Create a data processing register and manage relationships among vendors to aid in operationalizing privacy governance. If possible, take into consideration different regulatory perspectives that span cybersecurity and business to address current and prospective privacy compliance obligations.

Facial recognition: ten reasons you should be worried about the technology

Facial recognition technology is spreading fast. Already widespread in China, software that identifies people by comparing images of their faces against a database of records is now being adopted across much of the rest of the world. The rapid growth of this technology has triggered a much-needed debate. Activists, politicians, academics and even police forces are expressing serious concerns over the impact facial recognition could have on a political culture based on rights and democracy. With so many concerns about facial recognition technology, we desperately need a more prominent conversation on its impact on our rights and civil liberties.

Personal data in exchange for digital content and digital services: Directive 2019/770/EU

In the context of the digital single market strategy for Europe, the recent directives 2019/770/EU (concerning certain aspects of digital content supply contracts and digital services) and 2019/771/EU (relating to certain aspects of contracts for the sale of goods) can be greeted with particular interest. In particular, Directive 2019/770/EU introduces the express qualification of the transfer of personal data as consideration in the contract for the supply of digital content or services and as an obligation similar in all to the payment of the price. In this way, it can be said to be expressly regulated, in the sense of a translation in legal terms of such business models, the now widespread practice of the exchange of content or digital service against personal data, a phenomenon which nevertheless continues to be perceived by the user in terms of gratuitousness.
